Frequently Asked Questions

How are care charges calculated?

Local Authorities use a Government Guide - The Charging for Residential Accommodation Guide or CRAG - when making assessments. These rules are reviewed every year and changed from time to time.

Who is eligible for continuing NHS Healthcare?

A person should be entitled to full NHS funding of nursing home fees if their primary need is health. However, in many cases, the correct legal test is not being applied and families are losing out. With nursing home fees being on average £500 - £750 per week, the cost can escalate into thousands of pounds. If you feel you may be eligible for reimbursement of care home fees, contact our team today.

What is 'Continuing Healthcare'?

'Continuing Healthcare' is where the NHS is responsible for, and fully funds care. It mainly affects very ill patients, often elderly, in nursing homes, but it can also apply if a person is in hospital long term or needs nursing care at home.

Do I have to pay any legal fees?

No. Our panel of solicitors will enter an Agreement with you which may include an insurance policy to protect you against any costs. This means that if you win or lose your case you will not pay any legal fees and that if you are successful you keep 100% Compensation.

What will be expected of me?

You will be expected to co-operate with your solicitor and provide information to him when requested. Do not do anything to delay or prejudice your claim. Your solicitor will be there to guide you through the claims process.

Will I have to visit a solicitor?

No, you will deal directly with your appointed firm of solicitors who will correspond by telephone and in writing. Your solicitor and legal representatives will be there to answer any queries that you have with regard to your claim and will do all they can to obtain the best settlement for you. If you should wish to visit your solicitor however, your solicitor would of course be pleased to meet with you.

Key Facts:

  • If you are eligible for NHS Continuing Healthcare, you do not make any contribution towards long term care fees. The NHS pays the whole cost and it applies if a person is in hospital, care home or in their own home

  • The average weekly cost for care, per person, is £627. Therefore, if a person has been incorrectly paying care for one year, they have paid approximately £32,600 in total.
